You likely have built a life with your significant other that involves many shared responsibilities. These responsibilities can be personal, involving raising a child, or financial, involving investments and real estate.
When you are married, most of these responsibilities are shared, and thus ownership is shared and equal. When you divorce, they will be split equitably.
It is important to work cooperatively whenever possible as you protect your rights in divorce proceedings. The more amicable your split can be, the more control you will likely have over the outcome. You understand your family’s circumstances better than a judge in court ever could, so pursuing alternative dispute resolution methods (such as mediation) can often be in your best interest.
Children’s issues in same-sex marriages bring special challenges. While there may be accommodations on birth certificates in the future, we do not have that yet. We will work with you to make sure you maintain your parental rights to your child.
