How Long Will Child Support Payments Last in Texas?
In Texas, child support typically ends when a child turns 18 or graduates from high school, whichever happens later. But this rule comes with important exceptions. The actual end date of court-ordered child support depends on your child's specific situation.
Whether you're the parent paying support or the one receiving it, knowing your child support situation is important for your financial planning. If you have questions about your pending order in 2026, a Denton, TX child support attorney can help you.
When Can Texas Child Support Last Go Age 18?
According to Texas Family Code § 154, a court can order a parent to continue paying child support for an adult child who has a physical or mental disability that needs substantial outside care. For this to apply, the disability generally must have existed before the child turned 18. The court will look at the type of disability, the child's ability to support themselves, and both parents' financial resources when deciding the amount and duration of support.
This is an area where orders can look very different from case to case. Some parents reach agreements outside of court about long-term care arrangements. Others have support terms set by a judge. Orders for support of a disabled adult child may continue indefinitely and generally remain in effect unless modified or terminated by the court.
What Can End Child Support Before Age 18 in Texas?
Several circumstances can end a child support obligation before a child reaches adulthood:
-
The child gets married.
-
The child enlists in and is on active duty with the U.S. Armed Forces.
-
The child's "disabilities of minority" are removed by a court, which means the child can make decisions for themself without adult consent.
-
The child passes away.
-
The parental rights of the paying parent are terminated.
In most cases, a parent needs to notify the court and get an official order confirming that the obligation has ended. If the paying parent continues to make payments after a terminating event, the receiving parent isn’t always obligated to return the money. Parents should get the official order of termination as quickly as possible after support ends because of this.
Do Texas Courts Automatically Stop Child Support Payments When the Order Ends?
Child support payments don't always stop on their own. If your payments are processed through the Texas Child Support Disbursement Unit, the state will typically close the case once the child ages out. This is common when the Office of the Attorney General is involved. However, if your order was established privately through a court, you may need to take steps to formally close out the obligation.
Also, bear in mind that if you have multiple children and one ages out of support, support expectations will continue until the order is modified. In other words, when a support order covers more than one child, payment amounts will not automatically drop when the oldest child ages out. The paying parent needs to go back to court to have the order modified to reflect the lower number of children. Until a court officially modifies the order, the original payment amount remains in effect.
Whenever there are changes to your support order, whether because of a child aging out or support ending, it's worth confirming that your case has been closed and that no balance is owed. Unpaid child support in Texas is an infraction of the law and can accrue interest and affect your credit. If it goes on too long, it can result in enforcement actions like license suspension or wage garnishment.
